Purpose and scope<\/h2><p>This document contains Student Complaints Procedures.<\/p><p><span class=\"TextRun SCXW106854086 BCX0\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW106854086 BCX0\">The scope of the procedures is restricted to complaints in respect of the students\u2019 experience at the <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW106854086 BCX0\">School<\/span><span class=\"NormalTextRun SCXW106854086 BCX0\">, including services and facilities provided by Schools or any support services such as residential accommodation.<\/span><\/span><span class=\"EOP SCXW106854086 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><h2>2. Principles<\/h2><p><span data-contrast=\"auto\">2.1\u202f\u202f\u202f Students may ask for information, advice and help in making a complaint from anyone they wish. At any stage, the student has a right to be accompanied\/represented by another person who may speak on the student\u2019s behalf if s\/he requires it<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.2\u202f\u202f\u202f Malvern International welcomes comments and suggestions from students as to how the School might enhance its effectiveness and\/or improve its service. Students are encouraged to give suggestions through the student representative in their class.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.3\u202f\u202f\u202f The School recognises that from time to time students may have complaints about School facilities or services they receive from its staff.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.4\u202f\u202f\u202f These procedures aim to provide a simple and comprehensible means by which students may raise comments, suggestions and complaints with appropriate staff.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.5\u202f\u202f\u202f The School will ensure that the service and care provided to any student making a comment, suggestion or complaint will not suffer in any way as a result of the action taken, but the School expects that students will not engage in frivolous or vexatious complaints.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.6\u202f \u202f The School will maintain the confidentiality of comments, suggestions and complaints as far as possible. However, a service provider should normally be informed that a complaint has been made and that it is being investigated.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">2.7.\u202f \u202fThe above paragraph does not in any way prejudice existing procedures for dealing with staff disciplinary matters.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><h2>3. Complaints procedure<\/h2><h3>3.1\u00a0\u00a0\u00a0\u00a0Informal stage (refer to 2.1 above):<\/h3><p><span class=\"TextRun SCXW1859355 BCX0\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW1859355 BCX0\">It is hoped that many problems will normally be dealt with informally, in a spirit of conciliation without the need for recourse to a formal procedure. As a first step, a student who is unhappy with the service he\/she has received, should try to resolve the matter with his\/her tutor<\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">, the NCUK <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">S<\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">tudent <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">Services<\/span> <span class=\"NormalTextRun SCXW1859355 BCX0\">Officer <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">or with the <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">Academic <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">Director<\/span><span class=\"NormalTextRun SCXW1859355 BCX0\"> NCUK<\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">. However, if the response to the informal complaint is unsatisfactory the <\/span><span class=\"NormalTextRun SCXW1859355 BCX0\">student has the right to use the formal complaints procedure set out below. A student should only use <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW1859355 BCX0\">this formal complaints<\/span><span class=\"NormalTextRun SCXW1859355 BCX0\"> procedure if he\/she considers that the complaint is too serious to be dealt with informally or is dissatisfied with the results of informal discussions.<\/span><\/span><span class=\"EOP SCXW1859355 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><h3>3.2\u00a0\u00a0\u00a0\u00a0School stage<\/h3><p><span data-contrast=\"auto\">If the student wishes to make a formal complaint, they must raise the complaint within one month of the event concerned by completing the Malvern online complaints form.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The NCUK Academic Director will respond in person to the complaint within five working days. If the NCUK Academic Director thinks that the complaint needs further investigation they will explain to the student (or their agent) how the complaint will be processed. The complaint will be investigated fully (normally this will also involve an invitation for the student to discuss the complaint in person) and the student will normally receive a written response within ten working days.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">If the student is satisfied with the response received, and does not wish to take the complaint further, the information gained from the complaint will be used to improve the service provided by the School.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Complaints involving the NCUK Academic Director will be dealt with by\u00a0 the Malvern House London Centre Manager.<\/span><\/p><h3>3.3\u00a0\u00a0\u00a0\u00a0Appeals<\/h3><p><span data-contrast=\"auto\">If the complaint is not resolved within ten working days or is unsatisfactory to the student, the student should refer the complaint to the Malvern House London Centre Manager. If the original complaint was managed by this person then it will be escalated to the Malvern Head of Operations.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">They will investigate the complaint and the student will receive a written response within ten working days.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">If the student is satisfied with the response received, and does not wish to take the complaint further, the information gained from the complaint will be used to improve the service provided by the School.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><h4>3.3.1\u00a0Composition of the Complaints Committee<\/h4><p><span class=\"TextRun SCXW296151 BCX0\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW296151 BCX0\">If the student is still not <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW296151 BCX0\">satisfied<\/span><span class=\"NormalTextRun SCXW296151 BCX0\"> then the complaint will go to a Complaints Committee. <\/span><span class=\"NormalTextRun SCXW296151 BCX0\">No member of the Complaints Committee shall have had any <\/span><span class=\"NormalTextRun SCXW296151 BCX0\">previous<\/span><span class=\"NormalTextRun SCXW296151 BCX0\"> connection with the case. The Complaints Committee will be <\/span><span class=\"NormalTextRun SCXW296151 BCX0\">comprised<\/span><span class=\"NormalTextRun SCXW296151 BCX0\"> of:<\/span><\/span><span class=\"EOP SCXW296151 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li>The complainant<\/li><li>One Member of Board of Directors, <span class=\"TextRun SCXW231405226 BCX0\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW231405226 BCX0\">The HR Manager<\/span><span class=\"NormalTextRun SCXW231405226 BCX0\"> or a manager\/director of a different<\/span><span class=\"NormalTextRun SCXW231405226 BCX0\"> Malvern<\/span><span class=\"NormalTextRun SCXW231405226 BCX0\"> Centre<\/span><span class=\"NormalTextRun SCXW231405226 BCX0\"> (as <\/span><span class=\"NormalTextRun SCXW231405226 BCX0\">appropriate)<\/span><span class=\"NormalTextRun SCXW231405226 BCX0\"> as chair.\u00a0<\/span><\/span><span class=\"EOP SCXW231405226 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/li><li>One School Administrator from the Student Services team<\/li><li>One Student Representative<\/li><li>One Teacher<\/li><\/ul><h4>3.3.2 Terms of reference for appeals<\/h4><p>The terms of reference of the Complaints Committee shall be:<\/p><p>i) to consider a student\u2019s complaints in respect of her\/his experience at the School, including services and facilities provided by Schools or any support departments.<\/p><p>ii) to report its decisions to the Board of Directors and Student Representatives where appropriate.<\/p><h3>3.4\u00a0\u00a0\u00a0\u00a0Final appeals<\/h3><p>If the student is not satisfied with the results of the appeals stage they are encouraged to contact the accrediting bodies for
